Terms of Service

These Terms of Service ("Terms") govern your access to and use of WorshipDeck — including our marketing website at worshipdeck.ai, our web application, and related services (together, the "Service"). By creating an account, accessing a church workspace, or otherwise using the Service, you agree to these Terms.

Who we are

These Terms are between you and WorshipDeck, operated as an individual sole proprietorship doing business as WorshipDeck, located in the United States of America.

The service

WorshipDeck is web-based church presentation software that lets authorized users build and present services, slides, songs, media, and related content for a church or organization. Features, plans, and availability may change over time. Descriptions on the marketing site are for general information and may not reflect every plan or feature.

Accounts and authentication

You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account. Notify us promptly if you suspect unauthorized access.

If you create or administer a church workspace, you represent that you have authority to do so on behalf of that church or organization and to bind it to these Terms where applicable.

Church workspaces and content

The Service is multi-tenant. Each church or organization workspace is separate from others. You retain ownership of content you submit to your workspace ("Customer Content"). You grant us a limited license to host, process, transmit, and display Customer Content solely to provide and improve the Service.

You are responsible for Customer Content, for compliance with copyright and other laws (including licenses for songs, media, and scripture materials), and for managing member access and permissions. We may remove or restrict content that violates these Terms or applicable law.

Billing and subscriptions

Paid plans are billed according to the pricing and terms presented at signup or in the application. Fees are generally non-refundable except where required by law or expressly stated otherwise. Taxes may apply.

Subscriptions renew automatically unless canceled according to the cancellation options available in the Service or by contacting us. We may change plans or prices with reasonable notice; continued use after a change takes effect constitutes acceptance. Failure to pay may result in suspension or termination of access.

Acceptable use

You agree not to:

  • use the Service unlawfully or in a way that harms others;
  • upload or share content you do not have rights to use;
  • attempt to access another church's workspace or data without authorization;
  • interfere with the security, integrity, or availability of the Service;
  • reverse engineer, scrape, or abuse the Service beyond normal use; or
  • resell or sublicense the Service except as we expressly allow.

Intellectual property

The Service, WorshipDeck name, logos, software, and our materials (excluding Customer Content) are owned by WorshipDeck or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, or redistribute our materials except as permitted by these Terms or by law.

Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WORSHIPDECK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that Customer Content will never be lost. You are responsible for maintaining appropriate backups of important content.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WORSHIPDECK WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (B) USD $100.

Suspension and termination

You may stop using the Service at any time and may cancel a paid subscription according to the options available in the Service or by contacting us. We may suspend or terminate access if you breach these Terms, fail to pay fees, or if we discontinue the Service. Upon termination, your right to use the Service ends; provisions that by nature should survive (including ownership, disclaimers, and liability limits) will survive.

Changes

We may update these Terms or change the Service at any time. If we make material changes to the Terms, we will update the effective date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law rules.
